The arresting officer may ask you to perform what are known as field sobriety tests. For instance, lifting your foot or walking a straight line. You may also be asked to count or say the alphabet. These tests are normally done as a prelude to the offering of a chemical test. In Shelby County, your performance is probably being video taped. There is not penalty or loss of driver’s license for refusing a field sobriety tests and most experienced criminal defense attorneys would probably advise that you politely refuse to participate in the field sobriety tests. Most DUI arrests in Shelby County are on video. When you hire an attorney, you should request a copy of the video, if any, in your case. You should ask to view your video so that you can determine how you feel about the way you look in the video. Our office makes that a policy with all DUI cases. In most cases, particularly those without a test, the video will be a major influence as to the outcome of the case. After all, any judge or jury will have the opportunity to view the video when deciding your guilt or innocence of DUI. Your Picture is worth a thousand words.
